Terms & Conditions

1.1 Parties. These Terms & Conditions ("Terms") form an agreement between DBT Group Pty Ltd (ABN 66 699 954 839), trading as The Black Swan Tattoo Studio ("Studio", "we", "us", "our"), and the person who purchases or uses a Studio Membership ("Member", "you", "your").

1.2 Acceptance. You accept these Terms when you sign up for a Membership, accept them electronically, make a Membership payment, access Member benefits or otherwise continue to use the Membership after being given reasonable notice of these Terms.

1.3 Other Terms. Tattoo bookings, deposits, consultations, consent forms, promotions, giveaways, website use, aftercare and privacy may also be subject to separate Studio terms or policies.

1.4 Consumer Rights. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or another applicable law.

2.1 Eligibility. You must provide accurate and current information when joining. We may reasonably request identity verification to protect Member accounts, Studio Credit and rewards.

2.2 Tattoo Eligibility. Membership does not establish that you are legally eligible or medically suitable to receive a tattoo. Tattoo procedures remain subject to applicable Western Australian law, Studio policy, artist assessment and consent requirements.

2.3 Personal Membership. Membership, Member Portal access, Studio Credit, referral codes and benefits are personal to the Member and cannot be sold, transferred or shared without our written approval.

2.4 Account Security. You are responsible for keeping your email account, verification codes and Portal access secure.

2.5 Contact Details. You must keep important contact details, including your email address, current.

3.1 Member Plan. The Member plan is $19.99 per month. While active and paid, it ordinarily includes $20 Monthly Studio Credit, a $50 birthday reward, one free numbing cream tube, Member Flash Day offers, $10 referral credit for qualifying referrals, bonus giveaway entries and Members Mini Fridge access.

3.2 Premium Member Plan. The Premium Member plan is $49.99 per month. While active and paid, it ordinarily includes $50 Monthly Studio Credit, a $100 birthday reward, Premium anniversary gift, one free numbing cream tube per eligible tattoo session, Member Flash Day offers, $10 referral credit, bonus giveaway entries, Members Mini Fridge access and 20% off eligible Studio merchandise.

3.3 No Guaranteed Saving. Membership is a loyalty and credit program. The value obtained depends on how you use your Studio Credit and Membership benefits.

3.4 Availability. Physical products, gifts, refreshments and similar benefits remain subject to reasonable availability and may be replaced with a reasonably comparable benefit where necessary.

4.1 Recurring Billing. Membership is billed monthly in advance using the payment method selected at sign-up and automatically renews each month until cancelled.

4.2 Authority to Charge. By joining, you authorise the Studio's payment provider to charge the applicable recurring Membership fee to your nominated payment method.

4.3 GST. Prices are stated in Australian dollars and include GST where applicable unless stated otherwise.

4.4 Failed Payments. If payment fails, payment may be retried and access to new Membership benefits may be suspended until payment is successfully received. Monthly Studio Credit will not ordinarily be added for an unpaid billing period.

4.5 Payment Provider. Payments may be processed using a third-party payment provider and may also be subject to that provider's applicable terms.

4.6 Price Changes. We may prospectively change Membership pricing by providing reasonable advance notice. You may cancel before the new price first applies.

5.1 Nature of Studio Credit. Studio Credit is a non-cash account credit recorded against your Member profile and redeemable toward eligible tattoo services supplied through The Black Swan Tattoo Studio.

It is not a bank deposit, cash account, gift card or investment.

5.2 Monthly Credit. Following confirmation of a successful recurring Membership payment, ordinarily $20 is added to a Member account or $50 to a Premium Member account.

5.3 Redeeming Studio Credit. Studio Credit may be applied toward eligible tattoo services with participating artists operating through the Studio, subject to booking availability, consultation, artist approval and normal Studio booking processes.

5.4 No Cash Redemption. Studio Credit cannot be withdrawn, exchanged for cash, transferred to another person or used to obtain cash change except where required by law.

5.5 Expiry Order. Where multiple types of credit have different expiry dates, we may apply credit that expires sooner before longer-dated credit where technically possible.

5.6 Corrections. We may correct genuine administrative errors, duplicated transactions, payment reversals, fraud or technical errors affecting a Member balance.

5.7 Following Cancellation. Monthly Studio Credit validly added to your account is not converted to cash when Membership ends. Unless a longer period is required by law, that Monthly Studio Credit remains redeemable for 12 months following cancellation.

Promotional, birthday, referral, reward-code or other bonus credit may have different eligibility and expiry rules.

5.8 No Guaranteed Appointment. Holding Studio Credit does not guarantee a particular artist, tattoo, appointment time, design, session length or price.

Birthday rewards are loyalty benefits available to eligible active Members. Members must provide an accurate date of birth.

The ordinary birthday reward is $50 for Members and $100 for Premium Members.

A birthday reward may only be received once in each 12-month period and cannot be duplicated through multiple accounts or repeated cancellation and rejoining.

Where the Member Portal requires a reward to be redeemed before becoming Studio Credit, it must be redeemed during the eligibility period shown in the Portal or otherwise communicated by the Studio.

Unless stated otherwise, an unredeemed birthday reward may cease to be available when Membership ends.

Eligible Members may receive a unique referral code.

A referred customer must enter the valid referral code through the approved Member Portal process or another method specified by the Studio.

A referral ordinarily becomes successful after the referred customer completes a qualifying Membership sign-up and applicable validation requirements.

The standard reward is $10 Studio Credit to the referring Member per qualifying successful referral.

Self-referrals, duplicate accounts, fraudulent sign-ups, reversed payments and activity primarily intended to artificially generate rewards are not eligible.

Referral codes must not be promoted using unlawful spam, misleading statements, impersonation or conduct reasonably likely to damage the Studio.

Promotional codes, early-bird offers, launch bonuses and other reward campaigns may have specific dates, redemption limits, eligibility requirements and expiry periods.

Unless stated otherwise, promotional codes are limited to one redemption per eligible Member and cannot be sold, transferred or duplicated.

Where a promotion requires active Membership, an unredeemed promotional benefit may deactivate if Membership ends where this condition was disclosed.

We may refuse or reverse benefits obtained through fraud, deliberate technical exploitation, duplicate accounts or an obvious system or pricing error.

Membership may include bonus entries or eligibility for Studio giveaways.

Individual giveaways may have separate official promotion terms covering eligibility, entry periods, prizes, draw processes, winner notification, redraws and regulatory requirements.

Membership or additional entries do not guarantee a prize.

Prizes may include goods, cash, services or Tattoo Credit depending upon the specific promotion.

Where necessary to comply with applicable law, a promotion may be reasonably modified, suspended or cancelled.

Member Flash Day discounts apply only to eligible Flash Day artwork, artists, booking periods and prices identified for the particular event.

Discounts cannot ordinarily be retrospectively applied to completed bookings.

The Premium Member 20% merchandise discount applies to eligible Studio merchandise while Premium Membership is active.

Clearly disclosed exclusions may apply to third-party items, collaborations, gift cards, limited releases or already-discounted merchandise.

Complimentary numbing cream supplied as a Membership benefit remains subject to availability, lawful supply, product directions, product suitability and artist or Studio requirements.

Tattoo artists and Studio staff do not provide medical advice merely by supplying or discussing a topical numbing product.

Members must disclose relevant allergies, sensitivities, medications or health concerns through normal Studio consultation and consent procedures.

A tattoo artist may decline or discontinue numbing cream where they reasonably consider it unsuitable for the tattoo, skin, placement, session or tattooing process.

Members Mini Fridge access is a complimentary Studio amenity available while the applicable Membership remains active.

Products are subject to availability and reasonable use limits. Membership does not guarantee any particular product, quantity or brand.

Members remain responsible for checking the suitability of food and beverages for allergies, dietary requirements or intolerances.

13.1 Membership is not a booking. All tattoos must be separately discussed, quoted and booked.

13.2 Artist Discretion. Artists may accept or decline projects based on style, scope, placement, safety, scheduling or professional judgment.

13.3 Tattoo Pricing. Tattoo pricing may vary according to artist, design, placement, size, complexity and session length. Membership does not freeze tattoo prices unless expressly stated in writing.

13.4 Deposits and Booking Policies. Tattoo deposits, cancellations, rescheduling and no-show requirements are separate from the recurring Membership fee and may be governed by separate Studio booking conditions.

13.5 Artists. Some tattoo artists may provide services as independent contractors operating through the Studio. Membership benefits and Studio Credit are administered by the Studio.

13.6 Safety. Tattoo procedures remain subject to lawful age requirements, informed consent, infection-control requirements, artist assessment and Studio health and safety procedures.

Members may cancel Membership at any time using the cancellation process made available by the Studio or by contacting us through an official Studio contact channel.

Cancellation stops future recurring Membership payments after the cancellation takes effect.

Cancellation should be completed before the next renewal is processed to avoid that renewal charge.

Unless required by law or otherwise expressly offered by us, Membership fees already paid are not automatically refundable because you change your mind or do not use the available Membership benefits.

Valid Monthly Studio Credit already added remains subject to clause 5.7.

We do not charge a separate cancellation penalty.

We may reasonably suspend or terminate Membership for serious or repeated breaches of these Terms, fraud, abusive or threatening conduct, misuse of the Member Portal, unlawful activity, deliberate reward manipulation, chargeback abuse or a material safety or security risk.

Where appropriate, reasonable notice and an opportunity to address the issue will be provided.

Immediate action may be taken where reasonably necessary for safety, fraud prevention, legal compliance or security.

Active Membership benefits may also be suspended while a recurring payment remains unpaid.

We may reasonably update benefits, processes, technology or these Terms to reflect changes in law, cost, suppliers, systems, security or Studio operations.

Reasonable advance notice will be provided where practicable for material changes that adversely affect existing Members.

If you do not accept a material change, you may cancel your Membership before it takes effect.

A program change will not be used to retrospectively remove valid Monthly Studio Credit already added to an account except for genuine corrections, fraud or where required by law.

The Member Portal allows Members to view selected account information, Studio Credit, rewards and Membership functions.

The Portal may occasionally be unavailable because of maintenance, updates, internet outages or technical issues.

Internal Membership, payment and Credit Ledger records may be corrected where an error is identified.

Members must not bypass security controls, exploit technical errors, impersonate another Member or access another person's account.

We may collect and use personal information reasonably required to administer Membership, payments, Studio Credit, rewards, referrals, bookings, customer support, fraud prevention and legal obligations.

Members may receive service communications reasonably necessary to operate Membership, including payment notices, security codes, Portal access information, reward notifications and important Terms updates.

Marketing communications will be managed in accordance with applicable Australian law and available unsubscribe requirements.

Third-party systems may be used for website hosting, email, payment processing and Membership administration.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded.

Where goods are supplied as part of Membership, applicable consumer guarantees continue to apply.

Any statement in these Terms regarding refunds, cash redemption, cancellation, expiry, liability or availability remains subject to your non-excludable rights under Australian law.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

To the extent permitted by law, the Studio is not responsible for loss caused by Member fraud, misuse of benefits, failure to follow lawful Studio or product directions, unauthorised account sharing or materially inaccurate information supplied by the Member.

To the extent permitted by law, neither party is liable for remote or unforeseeable loss.

If you believe there is an issue with Membership fees, Studio Credit, rewards, bookings or benefits, please contact the Studio promptly with enough information for the matter to be investigated.

We will attempt to resolve complaints fairly and within a reasonable time.

Nothing in these Terms prevents you from exercising rights available through Consumer Protection Western Australia, the ACCC, a court, tribunal or another applicable body.

22.1 Governing Law. These Terms are governed by the laws of Western Australia and applicable Commonwealth laws of Australia.

22.2 Severability. If part of these Terms is found invalid or unenforceable, the remaining provisions continue to operate to the extent permitted by law.

22.3 No Waiver. A failure or delay in enforcing a right does not automatically waive that right.

22.4 Agreement. These Terms, together with applicable Membership descriptions, promotional conditions and expressly incorporated Studio policies, form the agreement governing Membership.

22.5 Electronic Notices. Notices may be provided electronically through email, the Member Portal or Studio website where lawful and reasonable.
